Imperfect Self Defense
(continued from home page)

Jeremy was told to stop several times. The last shove caused LG’s bat
bag, in which he was wearing like a backpack, to slip off his shoulder
and fall to the ground beside him.  LG then pulled his bat out of his
bag as a deterrent.  It was only when Jeremy stepped toward LG in a
threatening manner, LG, fearing for his safety, gave a check (half)
swing to Jeremy’s leg thinking he would finally stop assaulting him.
Lunging toward LG in anger, LG then took a blind swing all in self
defense.  Unfortunately, this second swing caught Jeremy on the neck,
severing an artery.  This was the cause of death.  This incident had
absolutely nothing to do with a baseball game or being teased about a
game, as reports state.  It had everything to do with being violated and
assaulted
. LG was defending himself against a teen two years older,
nine inches taller, 103 pounds heavier and one much stronger that
he.  LG did not intentionally cause Jeremy’s death.  This was a freak
accident in which neither of these teens willed.
